Not especially exciting, but necessary:

By hiring Casey and Monica Real Estate Marketing Pty Ltd for the provision of any real estate marketing products or services, you are bound by the following terms and conditions. This constitutes a legal agreement between yourself and Casey and Monica Real Estate Marketing Pty Ltd. This agreement also applies to any usage of our real estate marketing products, regardless of whether you have engaged us or not, and we reserve the right to seek monetary compensation for any usage of our products or services.

Regarding Copyright/ Image Retention:

All images and files remain the copyrighted property of Casey and Monica Real Estate Marketing Pty Ltd. We reserve the right to use and publish images for our own advertising, self-promotion, and in industry competitions. Under NO circumstances are any of the photos, videos, floor plans or copy-writing, or any other products or services we offer,  we supply to be altered in ANY way without our express permission.

Product Usage Rights: 

Limited usage rights are transferred to the paying client for the duration of the property listing. This is an individual and non-transferable license that allows use of the images for all marketing material and campaigns associated with promoting the specific property and the agent, for the duration of the listing.

This license is only granted to the paying client and not to any third party, including but not limited to builders, architects, staging professionals, other real estate agents, designers, publications, buyers or sellers. Use of the images by such third parties requires written permission from Casey and Monica Real Estate Marketing Pty Ltd, and will be invoiced accordingly.

Images cannot be sold or passed on to another agent who takes over an expired or withdrawn listing.

An exception to the third party is the home owner, who, upon request, will be provided a copy of the images for their personal, but not commercial, use. If said home owner passes on any of our marketing products to a third party. eg. a real estate agency, we will invoice that real estate agency for the use of those marketing materials.

If images are to be published in any sort of trade publication, written permission must be sought from Casey and Monica Real Estate Marketing Pty Ltd, and full credit to Casey and Monica Real Estate Marketing Pty Ltd is required.

Regarding the Photo Shoot:

All tenanted and vendor properties will be shot ‘as is’, and it is the responsibility of the client to ensure the property is ready for photos i.e. clean and devoid of clutter, before we arrive for the photo-shoot.

 

We will provide, if requested by the client, within reason and as we deem appropriate, advice and assistance with regards to minimal styling, if necessary, and for untenanted properties only. Please note that we do not charge for this additional service, and as such, any styling, removal of clutter etc. will be done entirely at our discretion. 

 

Regarding tenanted properties; they will be shot as is- no exceptions. If the client requires items to be moved or any styling to be done, the client must be present during the photo-shoot and ensure the property is photo-ready before we arrive. 

 

Any features of a property that may be considered to be detrimental to the sale of that property eg. power lines, holes in walls, broken fixtures or fittings etc., will not be removed from any images.

Unless previously instructed by the client as to specific shots desired,  Casey and Monica Real Estate Marketing Pty Ltd will use their skill and creativity to photograph the property and showcase it in the best possible way.

Making good on payment: 

​

The client/s understand that the quantity of photographs taken can vary greatly, as do the properties we provide marketing products and services for, and that real estate photography by nature is an art, subject to the creativity of the photographer and his/ her personal artistic style. The client/s understand that he/she has chosen the photographer because of his/her photographic style and experience, and will grant the photographer the right to exercise his/ her creativity in the interest of creating the best images possible. The client/s understand he/she may not demand a refund, seek compensation, or a redo due to differences in artistic preferences of the final images, and additionally, the client/s acknowledge and respect the experience and quality of the Photographer, and will make good on payment for any products and/ or services we have been engaged to provide. Payment in full must be made strictly within the time frame specified on the invoice.

If you use any of our products or services, we reserve the right to invoice you and expect payment in full strictly within the time-frame started on said invoice.

Regarding Copy-Writing: 

​

Please be aware that we retain the copyright, and that any copy-writing or text we provide may NOT be edited in ANY way without our express permission. If you would like the copy we supply edited in any way, please let us know and we'll happily make any changes you require. As with all of our marketing products, the copy we provide is for single-use only, is non-transferable, and may only be used for the duration of the listing.

By its very nature, copy-writing will only ever be personal opinion, based on personal experience, observation or information provided by third parties such as real estate agents, government agencies and vendors, none of which is verified as fact. It is entirely the responsibility of any prospective purchasers to undertake their own investigations and to form their own opinions. Additionally, the copy we write is frequently edited by both agents and vendors, sometimes without our knowledge or respect of our copyright, and Casey and Monica Real Estate Marketing Pty Ltd will not be held responsible for any misinformation or misrepresentation of a property as a result of this.

Regarding Floor Plans:

Whilst every attempt will be made to ensure the accuracy of all floor plans we provided by us, measurements of doors, windows, rooms and any other items are approximate and no responsibility will be taken for any error, omission or mis-statement. Our floor plans are for illustrative purposes only and should be used as such by any prospective purchaser. The services, systems and appliances have not been tested and no guarantee as to their operability or efficiency can be given.  All fixtures and fittings are for display purposes only. Dimensions are shown in metres, unless otherwise stated. We retain the copyright.
